Building Defects

A building work that is faulty or below a reasonable standard of quality.

A body corporate has statutory obligations under the Body Corporate and Community Management Act 1997 (Qld) to maintain the common property in good condition. In certain schemes established under a building format plan, there are also additional obligations relating to balustrading and roofing membranes.

Whether or not a body corporate has a claim against a builder, it must still carry out its obligations to maintain common property. Defects and problems such as inoperative elevators, roof leaks and unsafe balustrades are issues that must be addressed.
